Citing Delaware’s “Unpredictable and Overly Litigious” Environment, Boat-Maker Twin Vee Powercats Has Left Delaware
Dear Friends, I wrote earlier this week about the large number of companies leaving or planning to leave America’s First State, including Liberty Live Holdings, which has moved to Nevada, and Twin Vee Powercats, which was planning to leave Nevada. Now, folks, it turns out boat-maker Twin Vee has left Delaware. What I find most alarming and telling is the reasons they cited for leaving, citing Delaware’s legal climate as unpredictable and overly litigious, as Nevada offers more stability, flexibility, and cost savings. The company shareholders voted — at an 83 percent rate — to leave us. You can bet “unpredictable and overly litigious” will catch the attention of other companies based here and that they will, at a minimum, consider whether it is in their best interest to incorporate in Delaware or stay here if they are already based here.
I’ve been alarmed about this trend for years and have been writing about it in this space, yelling as loud as I can, so those in power in our great state could solve this. All of that said, even I am surprised at the number of companies choosing to leave us in Delaware.
